Please read these Terms carefully before using ShopperSmart. These Terms constitute a legally binding agreement between you and ShopperSmart Technologies Pvt. Ltd.
1. Acceptance of Terms
By accessing or using ShopperSmart (shoppersmart.in), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use our platform.
2. Eligibility
You must be at least 18 years of age to use ShopperSmart. By using our services, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts of users found to be minors.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@shoppersmart.in if you suspect unauthorised access.
4. Product Listings & Pricing
We strive to keep product descriptions and prices accurate. However, errors may occur. We reserve the right to cancel orders where prices were listed incorrectly due to technical error, notifying you and issuing a full refund. MRP displayed is as per the product packaging.
5. Payment
All prices are in Indian Rupees (INR) and inclusive of applicable GST. Payment is processed securely by Razorpay. We do not store card details. By placing an order, you authorise us to charge the stated amount to your chosen payment method.
6. Order Cancellation
We reserve the right to cancel orders in cases of: out-of-stock situations, pricing errors, suspected fraud, or inability to deliver to the specified address. In all such cases, a full refund is issued within 3–5 business days.
7. Intellectual Property
All content on ShopperSmart — including text, images, logos, and software — is the property of ShopperSmart Technologies Pvt. Ltd. or used under licence. Unauthorised reproduction, distribution, or modification is prohibited.
8. User Conduct
You agree not to: (a) use the platform for unlawful purposes; (b) submit false or misleading reviews; (c) attempt to gain unauthorised access to our systems; (d) use automated tools to scrape or interact with the platform without written permission; (e) impersonate any person or entity.
9. Reviews & User Content
By submitting a product review or any other content, you grant ShopperSmart a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use that content on our platform and marketing materials. You warrant that you own the content and that it does not infringe any third-party rights.
10. Limitation of Liability
ShopperSmart's total liability to you for any claim arising from your use of our platform shall not exceed the amount you paid for the order in question. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
12. Changes to Terms
We may revise these Terms at any time. Material changes will be communicated via email or site notice at least 14 days in advance. Continued use constitutes acceptance of the revised Terms.
